Court dismisses reconciliation application over estates benefits

Chelstone senior local court magistrate Charity Milambo has dismissed a case of reconciliation over deceased estates due to issues attached which needed to be sorted out.

Lawrence Banda, 49, a garden boy of Rufunsa sued his sister Belena Banda, 43, for reconciliation of over deceased relative’s estates alleging that she and the other sisters got rentals without him being involved.

“Belena is my sister and she’s the administrator. My father died in 2014 and left behind eight children, a house and a farm of which the house is on rent but since then I have never received hard cash from her and she doesn’t even share with me.

“ We have never held a meeting to see how things are moving, in short she doesn’t do anything and that is why  I am here for reconciliation,” said.

Lawrence further said that the administrator had failed to  satisfactorily discharge her duties in that respect as she had failed  to consider other siblings as part of the family.

And in defence, Belena denied the allegations saying she did not get any rentals money but her young brothers did so.

 “ My brothers offered to be getting the money and bring to me, but when they get the money they don’t give me  or my mother, and now it’s another story,” she said

Reconciliation could not be considered by the court which noted that there were too  many issues attached to the matter which needed to be sorted out.
