MP CORNERED IN CAR DEBT, TO FORK OUT K180,000

UNITED Party for National Development (UPND) Member of Parliament for Itezhi-Tezhi, Herbert Shabula, has agreed to pay the K180, 000 he owes a Lusaka businessman for the purchase of a Range Rover Vogue motor vehicle.

In this case, Mike Matakala sued Mr Shabula in the Lusaka High Court for allegedly failing to pay K180, 000 for the purchase of the said vehicle.

However in a consent judgment entered by the parties, it was agreed that Mr Shabula pays Mr Matakala the sum of K180, 000 and K20, 000 as costs.

The consent judgement states that the judgement sum and costs shall be paid in two months installments with the first payment of K100, 00 to be made on the last day of this month end (September 2019) while the remaining payment would be done on the last day of October 2019.

“The defendant shall be at liberty to settle the entire judgment sum or any balance thereof before the scheduled date. In default of payment on the last day of the scheduled months the defendant shall be allowed a further five working days to make payments,” the consent judgment read in part.

It further stated that if Mr Shabula fails to honor the agreement, Mr Matakala shall be at liberty to enforce judgment by a way of a writ of Fierie Facias (engage the bailiffs) without leave of the court and to be entitled to costs associated with the action.

Mr Matakala stated in a statement of claim filed in the Lusaka High Court that on June 7, 2018, he sold his motor vehicle, a Range Rover Vogue, black in color, and registration number BAA 3340, to the MP at the price of K180, 000, which was to be paid by July 30, 2018.

He said that Mr Shabula failed or neglected to settle the amount, as agreed, despite repeated efforts to get him to do so.
