Civil engineer who drank K461 worth of beers sued

THE Chilenje local Court has ordered a civil engineer to pay K461 he owes a businesswoman of Lusaka for drinking her beers.
Nora Maluti, 33 of Woodlands sued Masilino Mwansa, 27, a civil engineer of Johannesburg, South Africa.
They were appearing before senior local court magistrate Ackim Phiri, sitting with senior local court magistrate Harriet Mbewe.
Maluti said in June Mwansa and her friends drank beers worth K461.
She said Mwansa drank alcohol with his friends in her bar and promised to pay before leaving.
“As they were drinking, there was a person selling shoes outside. Mwansa went out to have a look at the shoes,” she said.
“A few minutes later, he said he will return and drove off. When he returned in the evening, he told me that he was involved in a road accident and didn’t have money,” she said.
He promised to pay the K461 the following day but he did not do so and even she tried to call him but he failed to pick her calls.
“Because I didn’t know where he was living, I contacted his girlfriend. She called him and he came and he promised to pay.I have sued him so that he can pay K 461 he owes me,” she said.
In his defence, Mwansa admitted having drunk the beers at Malutis’ bar in company of his friends.
“We drunk beers worth K461 but I didn’t pay immediately because after leaving for a short while I was involved in a road traffic accident,” He said.
“I didn’t have money to pay the bill that day. I went back the following day and drunk more beers. I asked her boyfriend to give me time to settle the accident issue before I settle the bill,” he said.
Mwansa said a few days later he was surprised that they reported me to the police and confronted my girlfriend at her work place.
“I do not owe her because I paid the K461 to her boyfriend’s wife because I knew the boyfriend as the owner,” He said.
The court ordered Mwansa to pay Maluti K461 this month end.
