A POLICEWOMAN of Lusaka who was sued in the Chelstone Local Court for calling her neighbour a prostitute and accusing her of sleeping with her father was set free because of lack of solid evidence

This was heard in a case in which Emma Mutale, 26, of Foxdale sued her neighbour Helen Nambeya, 29, a police officer of the same area for defamation of character.

Mutale told senior magistrate Charity Milambo that Nambeya accused her of sleeping with her father after the two picked up a quarrel.

“The issue started on November 17 when one of the tenants sent my daughter to buy her some beers at the bar. She found Nambeya who told her to come and tell me that she doesn’t like me and she is my enemy,

“My daughter came and told me exactly what she was told and so I went there to confirm only to be shouted at. She told me that I am a prostitute I sleep with my father.  She defamed my character and that of my father because he is a pastor,’’ Mutale said.

One of Mutale’s witnesses Dora Banda said she heard Nambeya referring to Mutale as a prostitute who slept with her father.

In defence, Nambeya denied the allegations, saying Mutale her husband’s former girlfriend.

She further denied calling Mutale a prostitute but said she was different from her (Mutale) who kept bearing children under her father’s roof.

“We started exchanging words at the bar and so the owner of the place told us to go outside because of the noise we were making, that’s where I told her that she keeps bringing children under her father’s house,

“She insulted me and said no wonder my husband cheated on me and followed her because she is taller than me,’’ she said.

But on hearing from both parties, the court then dismissed the claim for lack of solid evidence because it appeared they both contributed to the situation.
