A 53-YEAR-OLD farmer and a grade 12 pupil yesterday pleaded not guilty to two counts of sodomy in a Lusaka magistrates’ court.
Douglas Watt of Farm number 4007 in Chisamba and a 17-year-old boy are facing two counts of unnatural offences and two of possessing obscene material.
Particulars of the offence in the first count are that between May 2019 and July 17, 2019 Watt had carnal knowledge of the juvenile against the order of nature.
In the second count, the 17-year-old allegedly had unlawful carnal knowledge of Watt against the order of nature on the same dates.
The particulars in the third count are that on July 17, 2019 Watt possessed obscene pictures and videos on a cellphone tending to corrupt morals.
In count four, it is alleged that on July 17, 2019 the boy had in his possession obscene pictures and videos on a cellphone tending to corrupt morals.
When the matter came up for plea before chief resident magistrate Lameck Mwale Watt and the boy denied the sodomy charges.
However, the accused could not take plea for the other charges because the Director of Public Prosecution has not yet issued consent to prosecute them.
Applying for bail pending trial through their lawyer Christopher Mundia, Watts and his suspected lover said they lived at permanent addresses and were able to provide sureties to secure their attendance.
The defence also asked for lenient bail conditions as the boy is in grade 12 and was expected to write his final examinations.
Magistrate Mwale granted the two cash bail of K10,000 for Watt and K5,000 for the juvenile.
The court also ordered that they provide two working sureties from reputable organisations bound in the sum of K10,000 each.
The case was adjourned to August 6, 2019 for trial in respect of count one and two.
