Court orders woman to settle her K3,000 debt

The Boma Local Court has ordered a 40 year old woman of Garden, Christine Kapyana to settle the K3, 150 debt she owes her friend following a failed business transaction.

Kapyana was sued by Miriam Pakati who Senior Local Court Magistrate Mpundu Mwape that in 2017 when she started doing business Kapyana, she cleared her shop so that they could properly do business from there. 

“I ordered some handbags from China for sale and gave her to sell. I later ordered some more bags, curtains and jackets and gave her to sell. She said she would give me the money bit by bit,” Ms Pakati said.

Later Pakati went to Uganda for some time and when she came back, she told Kapyana to give her mother the money but she did not do so.

“The other time I was in South Africa and my mother called me to tell me my child was sick. I told her to get in touch with Kapyana to collect money from her. But that did not happen because for reasons known to Kapyana,” Ms Pakati said.

When she tried to reach Kapyana, she started to giving excuses that her mother was unwell and that was why she failed to collect money from the clients she was dealing with.

“I only managed to get K750 from her for the curtains. I was supposed to go to South Africa so I told her to collect the rest from the clients. I left the country but whenever I call her, she does not answer my calls,” Pakati said.

The court upheld the claim and ordered Kapyana to pay the debt  in three installments.
