LUAPULA HYDRO LOSE COURT BID AGAINST WARMA

LUAPULA Hydro Power Corporation (LHPC) has lost an application it filed against the Water Resources Management Authority (WARMA) in-house lawyer Chapatama Ngaba in the Lusaka Magistrates’ Court.
LHPC applied to have Mr. Ngaba stop prosecuting the case concerning the applicant’s failure to surrender two water permits on grounds that he had conflict of interest.


Ruling on the application on Monday this week, Magistrate Nthandose Chabala dismissed LHPC’s bid on grounds that Mr. Ngaba could not be said to be conflicted because the roles, if any, he played in relation to the permits were not known.


In this case, WARMA had complained against LHPC for failing to surrender the two water permits but the power company wanted the court to order Mr. Ngaba stop prosecuting the case on the cited ground.
In dismissing LHPC’s application, Ms. Chabala said she will proceed to hear evidence in the case.
