15 months jail for stealing phone

A LUSAKA resident will serve 15 months in prison for robbing a man of his mobile phone and K1,800 cash.

Appearing before magistrate Martha Miti was Osteen Banda, 27, of Garden Township accused of robbing David Ndalama on September 20, 2019.

Facts were that Banda did or threatened to use violence before and after committing the offence.

His witness, Lackson Kamudenga, aged 33 of Garden said on September 20, 2019, he met with Banda in the evening.  He said they played a game of draught at his shop and later Banda left saying he had gone home.

He said he did not know where Banda had gone and what happened.

Banda pleaded for mercy saying he has a two-month-old baby and his family will suffer if jailed.

However, Magistrate Miti said the victim was assaulted and sustained cuts on the head and some of his teeth were broken.

She said apart from losing the mobile phone and money, Mr Ndalama was badly injured because of force used against him.

She said Banda deserved to be punished for acting in a manner that he did and sentenced him to 15 months imprisonment.
