Man to pay K1, 600 in a botched deal

A LUSAKA auto electrician has been ordered to pay K1, 600 to a driver by the Chilenje Local Court in failed business deal.
This is in a matter in which Ramsey Banda, 26, a driver of Mtendere East sued Joseph Banda, of Bauleni
Ramsey told senior local court magistrate Ackim Phiri sitting with senior local court magistrate Harriet Mbewe and presiding local magistrate Patrick Nyirenda in April Joseph sent him to Lundazi, Eastern Province to bring a truck to Lusaka.
He said Joseph promised to employ him as a driver when he brought the truck to Lusaka.
“At that time, Joseph didn’t have money. I used my K600 for fuel to go to Lundazi to get the truck. When I arrived there, I found that the truck wasn’t working. It took me three days to work on it and it started working.
“I then started coming back to Lusaka but on the way, I spent K1, 000 on toll gates fees and fuel and other repairs. When I arrived, Joseph changed his mind and employed another person to work with the truck,” he said
He told the court that he went faced a lot of difficulties to just bring the truck to Lusaka. I spent a total of K1,600 on the truck and I want him to refund me the money,” he said.
In defence Joseph told the court that in April this year he met Banda.
“I said I didn’t have money to bring the truck from Lundazi to Lusaka but he insisted on travelling. He went to Lundazi to get the truck but it had a problem. I told him to come back. I sent him K600 for diesel.
“He gave people lifts on the way and made K3,000 which he did not share with me. When he arrived in Lusaka he took the truck to his house,” he said.
Joseph said the next day, he went to Banda’s house and got the truck.
He said Banda wanted a refund of K800 for all the costs which he gave him.
“I could not give him the job as a driver of the truck because he is careless,” he said.
The court ordered Joseph to pay K1,600 refund in two instalments effective July 31
