Teen relieves sex ordeal with church elder

A 15-year-old girl has told the Kitwe Magistrate’s court that a church elder had sex with her in his vehicle while his four-year-old daughter slept at the rear seat.

The girl told the court that, Alick Simbeye, a church elder, whose family she had lived with for about two months, defiled her twice in July last year.

She said this yesterday when she testified in the trial of Mr Simbeye who is charged with one count of defilement alleged to have occurred on July 25, 2018.

The case was before senior resident magistrate Oswald Mwansa Chibalo.

The Juvenile told the court that prior to the two defilement incidents, she lived on the streets where she fled to, to escape maltreatment by her mother.

She said she decided to flee home to live on the streets because her mother was in the habit of insulting and beating her.

The girl explained that her mother was fond of abusing her every time she was drunk, and that she one time even insulted her grandmother when she tried to intervene.

At this point, the Magistrate ordered for proper investigations against Deborah Chopango, 30, the victim’s mother over the allegations of ill-treatment against her biological daughter.

The teenager told the court that the defilement incident took place in Simbeye’s Toyota Spacio car, at the corner of Buchi Hotel in Buchi Township, as the three of them were returning from night prayers around 23:00 hours.

She said that Mr Simbeye parked the vehicle near Buchi Hotel and locked all the doors, as his four-year-old daughter slept on the back seat.

According to the girl, Simbeye shifted his daughter to another seat and then moved to the back seat of the car to join her.

The girl told court that Mr Simbeye undressed and forced himself on her when she resisted his request to take off her pant.

She narrated that there was a knock on the window of the car while they were in the act, and Simbeye quickly dressed up and went to sit in the driver’s seat.

“He forgot to wear his underwear in panic,” she said.

She said Mr Simbeye attempted to drive off when he noticed that it actually a police officer who had knocked on the car window but his car hit into a metal bar.

The girl narrated that the church elder then engaged into a struggle for the car keys with the police officer but later managed to flee, abandoning the girl and his four-year-old daughter in the process.

She said that she was taken to the police station where she was examined by a female officer shortly before Mr Simbeye and his wife arrived claiming he was involved in an accident and that his two daughters had been taken by the police.

The teenager explained that the police questioned him about the underwear found in his vehicle and the alleged defilement but he refused knowing anything about it.

The police apprehended him while the girl was taken to the Young Women Christian Association (YWCA) shelter where she has lived ever since.

She told the court that the incident was the second one as he had earlier on defiled her in the same vehicle while parked in a play-ground at Mindolo Township.

She said he forced himself on her on both incidents and warned her against telling anyone about it.

The Magistrate adjourned the matter to Friday this week for continuation of trial.
