MOTHER OF DEFILED 2 YEAR OLD GIRL RELIVES ORDEAL IN COURT

THE mother of the 2 years 8 months old girl who was brutally defiled by a 13 year old boy told the Choma Fast Track and User Friendly Court for Gender Based Violence sitting as a Juvenile Court how she heard cries of a child but did not pay much attention
Appearing before Resident Magistrate Selia Kanunka, was a Juvenile boy from Macha area charged with defilement of a child contrary to section 138 subsection 1 Act No.15 of 2005 and 2011 of the Penal Code of the Laws of Zambia.
Particulars of the offence are that on September 2 the juvenile boy who is in Grade 1 allegedly had unlawful carnal knowledge of a girl below the age of 16.
When the matter for trial before Court, the girl’s mother testified that on the date in question, she and her husband were packing bricks while their daughter was playing with other children some 50 metres away near a Hand Water Pump.
She said when other children were called by their parents the accused Juvenile offender arrived to draw water while her daughter remained playing alone.
She later heard cries of a child but did not pay much attention.
“I heard the child crying but I did not pay much attention as the cries sounded like that of a little baby. Shortly I saw my daughter approaching us crying and she said the accused person had beaten her.
When she got closer I saw blood in between her legs.
“When I undressed her, the pants were stained with blood together with the skirt and her private part had a cut.” She narrated.
She said when the accused person was reported and confronted in front of his parents he denied sexually abusing the girl and said she hurt herself with the Water Pump.
But a closer look by the girl’s father he discovered that the Juvenile had blood stains on his shirt below the waist.
The matter was then reported to the Police where woman Constable Karen Saiko investigated the matter, and in court she presented the blood stained pants and Sskirt as part of the evidence.
The court found the Juvenile boy with a case to answer after he and his father failed to cross examine all the witnesses.
The matter comes up today 20 for defence and the juvenile’s police bond was extended.
