THE Boma Local Court has ordered a businessman of Lusaka’s Makeni area to pay a woman K2, 500 after initially borrowing K2, 000 from her.
Mwakoi Samana, 29 sued Michelo Phiri, 48 to be paid her money
Samana told senior local court magistrate Petronella Kalyelye that Phiri borrowed K2, 000 from their company last year which he has not get been paid back.
“We give salary advances at our company. We gave him K2, 000 which was supposed to be paid back within 30 days but to date it has not been paid,
“It’s now been a year and some months and he hasn’t paid. Our monies accumulate interest but we asked him to just pay the K2, 000,” she said.
In defence Phiri did not deny the allegations and said he had travelled and lost Samana’s phone number.
“I bought a car, on the way from Japan but it wa involved in an accident so I’ve been waiting for the balance that they promised to pay me at the end of December,
“When I met her I explained how I had some problems and could not pay back in good time but I promise to back the money,” he said.
He said the next time he spoke to Samana she just told him summons was waiting for him.
“I travelled but since I’m around now I will try to push and see if I can organize the money earlier than December so that I can pay her back,” he said.
On
Phiri’s own admission, the court found that the debt had been long overdue and
Magistrate Kalyelye ordered him to pay Samana K2, 500 instead.
