TEACHER FOUND WITH CASE FOR DEFILING 2 GIRLS

A RETIRED teacher at Lusaka’s Chitukuko primary school has been found with a case to answer in a matter he is accused of sexually abusing two girls and put on his defence.
Cherry Munyinya, 62, of Mtendere Township, is charged with defilement of a child contrary to Section 138 (1) of the Penal Code Chapter 87 of the Law of Zambia.
In count one it is alleged that between March 1 and June 29, 2018 in Lusaka Munyinya had unlawful carnal knowledge of a 10 year old girl.
In count two Munyinya is accused indecent assault on female contrary to Section 137 (1) of the Penal Code Chapter 87 of the Laws of Zambia.
Allegations are that on the same day Munyinya unlawfully and indecently assaulted a 9-year-old girl.
When the matter came up for ruling Lusaka Magistrate Faides Hamaundu said the State has established a prima facie case against Munyinya.
However Munyinya could not proceed with his defence after informing the court that he has bereavement.
He asked the court for some time as it was hard for him to abreast himself with the issue.
Magistrate Hamaundu then adjourned the matter to September 16, for start of defence.
In the last session, two grade 3 pupils testified that Munyinya tied their mouths and had carnal knowledge of them.
The girls further narrated that the teacher threatened that they would die in their sleep if they told anyone.
As trial continued, grandmother of the 9-year-old girl told court that according to her granddaughter, Munyinya gave her K2 to buy popcorns and told her to go to his place where he defiled her.
A police officer also told court that during his investigations, he discovered that the two9 girls were sexually abused.
Boas Monga, of Woodlands police station under Victim Support Unit narrated that in July 2018, while on duty his discovered that in detention was Cherry Munyinya for the offence of defilement.
“Acting on the matter, I opened a docket and instituted investigation in to the matter where it came to light that the victims where aged 9 and 10 from Mtendere and Kalikiliki,
“Upon interviewing the girls, it was revealed that between March and June 2018, the victims used to go to Munyinya’s premises within Chitukuko school where he would sexually abuse them one after another and in return Munyinya would give them money and crayons,” he said.
He said after interviewing the Munyinya who was already in custody, he made up his mind to charged and arrest him for the subject offences because he did not give a satisfactory answer.
Mr Monga said under warn and caution statement, Munyinya gave a free and voluntary statement denying the charge and was later released on police bond.
