FOUR people yesterday appeared in the Lusaka Magistrate court for allegedly kidnapping a 4-year-old boy and conveying him beyond Zambia’s borders.
Suspects in the matter are Musenge Mumba, 36, Lawrence Mulenga, 35, businessman, Gertrude Sichone, 30, of Chainda Avondale a businesswoman and Daisy Musukutwa, 34, a director.
In count one, Mumba is charged with giving false information to a public officer contrary to section 125 of the Penal Code Chapter 87 of the Laws of Zambia.
Allegations are that on April 13, 2017 Mumba gave false information to a judicial officer at the New Magistrates Court complex by filing petition for adoption of a four-year-old boy.
She claimed that the boy was a dumped child and mother not known thereby causing the judicial officer to issue adoption order and certificate of agency knowing the same information to be false.
In the second count, Mumba, Mulenga and Sichone are charged with kidnapping contrary to Section 251 and 254 of the Penal Code Chapter 87 of the Laws of Zambia.
It is alleged that between January 1, 2017 and July 31, in the same year in Lusaka and acting together the three suspects conveyed the boy beyond the limits of Zambia without the consent of Mungoti O’Brien Mateyo, the person legally authorized to consent on behalf of the boy.
And in the third count, Musukutwa is charged with destroying evidence contrary to Section 111 of the Penal Code Chapter 87 of the Laws of Zambia.
Allegations are that between January 1 and July 31 2017 knowingly that Nurse Handover book may be required in evidence in a judicial proceeding, Musukutwa wilfully removed or destroyed it with intent thereby to prevent it from being used in evidence.
When the matter came up before Chief Resident Magistrate Lameck Mwale, the four suspects could not take plea because only three of them were in court.
At this point Senior State advocate Bob Mwewa applied for a short adjournment to allow all four suspects be present for plea.
But the matter has been adjourned to August 27.
Outside court, one of the suspects Sichone who was not present in court when the matter was called fumed at journalists who were filming her.
