ABUSIVE HUBBY LOSES MARRIAGE IN COURT

THE Boma Local Court in Lusaka has dissolved a five year old marriage of a Garden compound woman and her 28 year old husband of Chipata compound on allegations that he is abusive.

This is a case in which Evelyn Banda,20 sued Moses Phiri for divorce because she had never stayed well in her marriage right from the start.

Banda told senior local court magistrate Peggy Nyambe that they got married in 2014 and have been on separation for the past two months.

“We have never stayed well from the start. He beats me too much and doesn’t provide enough for me and our child. When I report to his family, they beat me as well because they think I’m the problem,

“One time he drunk doom to kill himself and his family blamed and beat me,” she said.

She said her husband came home around 23:00hrs and gave her a K6 to buy food and cook him food. When she refused because it was too late she got another beating from him.

“He called me a bitch and beat me the whole night. Sometimes he would beat me so bad I would be in the house for two whole days nursing myself,

“Our child was in hospital one time. My husband didn’t even step a foot in the hospital or bring any money or food. When I asked him for money he told me ‘uzambo kudya mauzu’,” she said.

In defence Phiri told the court that he and his wife stayed well and only differed one time when he came home around 20:00hrs.

“I gave my wife a K20 to buy food and she refused and told me I should have eaten before coming home. We slept and she woke up around 23.00hrs, started shouting at me and pulled my manhood so I reacted,

“She left home the next morning and I followed her at  her mother’s house where she threatened to pour hot water on me,” he said.

The court found that there was violence in the marriage and Magistrate Nyambe granted the divorce. 

Phiri was also ordered to maintain his child with K300 monthly.
