JCS KILLING UPDATE: MURDER SUSPECT COMMITTED TO HIGH COURT (Pictures)

ONE of the juveniles accused of murdering their friend by stabbing him with a broken bottle on the neck, at a bar, has been committed to the High Court for trial while his co-accused has been discharged through a nolle prosequi following instructions from the Director of Public Prosecution (DPP).

When the matter came up yesterday, Public Prosecutor Noah Mwanza informed Lusaka magistrate Ruth Kapulo that he was in receipt of instruction of committal and a nolle prosequi in favor of juvenile offenders.

At this point, Ms. Kapulo committed the 17-year-old juvenile offender to the high Court and entered a nolle prosequi against the 16-year-old.

“Having received instructions from the DPP, I enter a nolle prosequi against accused number two and I discharge you.

As for first accused, this is a proper case for trial at the high court and there being no objection, I commit you to the High Court for trial,” she said. The incident happened at Lusaka’s JCS bar in Long Acres on April 6, 2019, when the duo allegedly murdered Sebastian Lungu, 20.

Before Lusaka Magistrate Ruth Kapulo yesterday were the juveniles aged 16 and 18 of Six Miles area and Kalingalinga compound, respectively.

It is alleged that on the material date, the two murdered Lungu, contrary to Section 200 of the Penal Code Chapter 87 of the Laws of Zambia.

According to then-acting Police spokesperson Danny Mwale, Lungu was stabbed in the neck with a broken bottle during a fight at JCS bar in Long Acres.

Mr. Mwale said Lungu, of Mtendere East, picked a quarrel with his friends and was stabbed with a broken bottle in the fight after which he died.
