A BUSNESSWOMAN of Lusaka has successfully sued her husband of 24years for divorce on allegation that he calls her a prostitute and has not spoken to her for almost a year.
This is a case before Chelstone Local Court presiding magistrate Mary Namangala in which Agness Chisamba, 42, of Chelstone sued her husband Jimmy Mwanza, 45, of Chelstone overspill area for divorce.
“My husband doesn’t talk to me when we quarrel, he goes quiet for two/three months or even a year without talking to me’’, said Chisamba.
She said that they got married in 1995 and have five children together but since then she had never experienced happiness in her marriage.
“I want divorce because I have never known the good side of marriage. My husband calls me a prostitute and a witch and his family doesn’t talk to me either and he goes quiet on me for a year. My husband has a child outside marriage, who I am keeping and feeding because he doesn’t buy food for the children.
“We don’t have sex any more. At one point he went to the village to get some medicine and tried to force me to drink it but I refused and since then he stopped talking to me,’’ she said.
Mwanza in defence said that the main reasons they had been having misunderstandings in their matrimonial home was because she denied him conjugal rights.
Upon hearing both parties, the Court granted the couple divorce and said no compensation should be awarded to either party.
Property acquired together to be shared equally and the first three kids to remain with the father while the other two will be kept by their mother and maintained with K500 every month.
