Fake virginity case tossed out

THE Chilenje Local Court has dismissed a case of virginity damage against a Kamwala man because it lacked merit.

Francis Malunga,32, of Kamwala was sued by Magreta Ngoma,37, of New Kamwala claiming that he deflowered and impregnated his sister three years ago.

But Malunga confessed to making Ngoma’s sister pregnant but denied deflowering her.

The girl too confessed that the Malunga was not the first man she had slept with.

However Ngoma said he discovered that his sister was in a family way when she was five months pregnant.

“We called Malunga and his family. The man agreed to impregnating my sister. However, disputes arose when his father refused to agree with our demands,

“We could not agree and because of that we never charged him and since then he has not been cooperative. We have made follow ups but they have not complied. The child is now two years old. I want the court to help me,” he said.

The two were appearing before senior local court magistrate Ackim Phiri sitting with senior local court magistrate Harriet Mbewe.

“We had sex during our relationship but the intention was not for her to get pregnant. I never denied the pregnancy or asked her to abort,” said Malunga

 “We gathered from both sides to discuss but disputes arose. We couldn’t agree.  My father was offended when one of the uncles of the girl said (why did you allow your son to jump through the window to sleep with our daughter,” he said.

The court dismissed the case because the lady confessed that Malunga was not the first man she had slept with. It then advised  Ngoma to sue for compensation for pregnancy
