MAN PICKS MOTHER OVER WIFE

A MARRIAGE of 26 years came to an end in the Chelstone Local Court in Lusaka after the husband picked his mother over his wife following the irredeemable wrangling over the role of the elder woman in the home.

The man caused laughter when during the hearing he told the court that each time he quarrelled with his ‘violent’ wife he would find a quiet place within the house and cry his lungs out.

Local court senior magistrate Charity Milambo sitting with Kennedy Mwansa Mutale did not have a choice but to dissolve the marriage of Emmanuel Mubanga, 56, of Mtendere East Township and Judith Musekwa, 48, of the same area.

Mubanga had sued his wife for divorce because of incessant quarrels and fights over who should be in control in the house between his wife and her mother-in-law.

He testified before the court that he and Musekwa had been married for 26 years and had two children together.

He had paid K100 pride price.

“My wife doesn’t respect me at all. She treats me like a child and is too violent. I remember at one point she gave me several warnings that she could beat me up,” he said.

Mubanga said Musekwa also used to boast that even people at the market place where she trades feared her because she beats.

One day they quarrelled and he beat her up.

“I am an emotional person so after the quarrels I went into the house and cried my lungs out,” he said causing some giggles across the courtroom.

“We stayed for almost a year sleeping in separate rooms. At this point I told my wife that I wanted to be staying with my mother here since she was old and sick.

“My wife refused saying she couldn’t stay with a witch who was bringing confusions in the house, referring to my mother. I got hurt and that’s how I moved out of the house and rented somewhere else with my mother,” Mubanga said.

He said he could not forsake his sick mother just because of his wife.

“My mother is sick and doesn’t have anyone to take care of her, and since my wife is refusing to keep her, I will move out with her. I would rather leave my wife than my mother, hence my coming to court, Mubanga he said.

In defence, Musekwa said problems started a long ago time in their marriage because her husband didn’t support his own children.

“My husband was caught red-handed in the house with my neighbour, who is my friend, and the matter was in court where he was charged K4,000 for adultery. Since then we have been having misunderstandings in the house,” Musekwa said.

But Mubanga insisted on divorcing her.

The court granted the couple divorce without any compensation for either party.

The court ordered that the family house be sold and the proceeds shared equally.
