Local court quashes virginity damage case

THE Chilenje Local Court has dismissed a case of virginity damage brought  against a man of Chilenje because it lacked merit.

Jeff Ngosa, 29 was sued by Mofya Chimembe, 45, of the same area for compensation over her daughter’s deflowering and pregnancy.

Chimembe said in 2018 she discovered that her daughter was pregnant and immediately summoned Ngosa to discuss the matter. 

“He came but he did not come with his relatives and asked to reschedule the meeting so that his elderly relatives would be present.

“He left and the other time we spoke to him was a few weeks before  my daughter was  to give birth. We called him again to remind him about the pregnancy,” she said

Chimembe said Ngosa asked her family to make a budget which it did. 

 “I want him to compensate me for damaging my daughter and impregnating her. She was supposed to continue with her school,” she said. 

The two were appearing before senior local court magistrate Ackim Phiri sitting with presiding Local court magistrate Patrick Nyirenda. 

Ngosa said he never damaged the girl but had a onetime stand and they used protection.

“I met her at the club at KCC in Kabwata around 01:00hrs last year. Because she was found there, I thought she was just a prostitute.

“I just used to see her around Chilenje and she agreed to sleep with me that night at a fee of K150 and I remember we used a condom,” he said.

The court dismissed the case because the girl said Ngosa was not the first man she had slept with. 

The court advised Chimembe to buy  summons for compensation for pregnancy.
